No Win No Fee Solicitors

You’ll often hear the phrase “no win no fee” in connection with personal injury cases, but what exactly is it all about? In very basic terms, no win no fee, or “conditional fee” to give it the proper name, is a way of enabling people to take legal action against someone or a company which has caused them harm, without having the money to find work as the case progresses. No win no fee does exactly as it says – you won’t pay any money to your lawyer until the case concludes in your favour. If you lose and aren’t awarded any compensation, then you won’t pay a penny.

How the System Works

The first step in any legal process is making an appointment with a firm of solicitors to discuss whether they think there are grounds for a case. There are several huge firms of solicitors who handle all sorts of compensation cases from medical negligence to claims against employers, and others which choose to specialise in one particular niche. Do your research and work out which firm is most appropriate. You’ll then attend an initial meeting with the solicitor, or speak to them on the phone, and go through the basics of the case. As solicitors will only get their fee if they win your case, they may not want to accept you as a client if they think your case is weak.
Once you’ve signed up with the solicitors as a client, they will then start gathering together evidence about your personal injury and any expenses you’ve incurred as a result. This could include taking statements from witnesses, looking at your medical records or asking for proof of your loss of earnings. Once the case has been put together, your solicitor will approach the legal team on the other side and the discussions about your compensation will begin. This process can take several months or even longer, depending on the amount of information which has to be gathered and how happy the other side are to negotiate.

Going To Court

It’s important to note that most compensation claims never get to court. Court fees are high, and it’s in everyone’s best interests to not let things get that far. An out of court settlement means that you’ll get your money quicker, your solicitor will get their fee quicker, and it avoids the stress and hassle of attending court. Your solicitor will have a good idea of what level of compensation you can expect for your type of claim, and when offers Howell’s Heating & Air Conditioning come in from the company you’re claiming against, will be able to give advice on whether to accept the offer, or hold out for more.

Paying the Legal Fees

When you have your initial meeting with a no win no fee solicitor, you’ll be asked to sign their contract stating what fee you’ll pay if successful. This is usually expressed as a percentage, and might depend on how complex your case is, and how much it will cost the solicitors in time and effort to put it together.
